Applied Underwriters, Inc., Official Contest Rules
These Applied Underwriters, Inc. Official Contest Rules (“Official Contest Rules”) apply to each Promotional Sales Contest (the “Promotion”) held by Applied Underwriters, Inc. (“Company”) as listed on the Company’s Official Contest Schedule (the “Contest Schedule”). Rewards apply to SolutionOne®, JumboGC®, Livery, Box Truck, and Blue Ridge Specialty program deals only.
For each Promotion, beginning at 12:00 AM PDT on the Promotion Start Date, as listed on the Contest Schedule, through 11:59 PM PDT on the Promotion End Date, also listed on the Contest Schedule (the “Promotion Period”), submit via email or fax new business submissions with an effective date within the Quotation Effective Period, as listed on the Contest Schedule, to the Company for SolutionOne®, JumboGC®, Livery, Box Truck, and Blue Ridge Specialty programs. Only complete bona fide submissions, as determined exclusively by the Company in its absolute sole discretion, will be valid. For rewards requiring deals to be closed, the deals must be closed by the Promotion End Date in order to be considered valid. Deals closed may be aggregated between programs. For purposes of determining the reward level for aggregate deal totals, deals closed through Transportation and JumboGC will be converted to the equivalent number of deals closed under SolutionOne® for that level. The number of deals is then aggregated to determine the appropriate reward level.
Rewards are awarded to quote and deal counts by individual producer, not agency. Qualifying participants are limited to one prize per category. For those categories requiring a count of quotes per month, quotes must be sent by 11:59 PM PDT on the last day of each month during the Promotion Period. For those categories with premium thresholds, deals must be closed by the Promotion End Date in order to be considered valid towards total annualized premium for the Promotion Period. Each category is determined as listed on the Company’s Official Contest Rewards and Categories (“Official Contest Rewards and Categories”). Qualifying participants can choose a specific category prize if they meet the category award standards, but only one prize per category will be awarded. The Official Contest Rewards and Categories shall govern if there is a conflict between it and any advertising material. Qualifying participants must be at least 21 years of age if an alcoholic beverage is chosen as a prize.
One ICON i40L golf cart has been customized with autographs by drivers from the 2022 Indianapolis 500. In the event that more than one producer qualifies at Level 10 to earn a golf cart, the autographed golf cart will be awarded to the producer with the highest aggregate annualized written premium total, and any other qualifying producers will receive an equivalent ICON i40L golf cart without customization. For rewards with options (size, color, right/left-handed, flavor, etc.), qualifying participants will work directly with their Company Sales Representative to determine a selection. All rewards will be shipped at the Company’s expense. Rewards will only ship to a physical address, no P.O. Box deliveries. For all alcoholic beverage shipments, someone 21 years of age or older must be available to sign for the shipment. No transfer, assignment or substitution of a prize is permitted. The Company reserves the right in its absolute sole discretion to substitute a prize for an item of equal or greater value in the event an advertised prize is unavailable. During COVID-19, supply chains may have been interrupted. Allow up to nine weeks for delivery after confirmation of the award.
The awarding of rewards shall be final, binding, and conclusively decided by the Company in all matters relating to this Promotion, including, without limitation, qualification for a prize. By participating in this Promotion, entrant agrees to abide by these Official Contest Rules, which are a contract without limitation and a limitation of your rights and remedies as detailed herein. This Promotion is void where prohibited by law.
Except where prohibited by law, each entrant and/or qualifying participant agrees that: (1) any and all disputes, claims, and causes of action arising out of or connected with any Company Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by arbitration with the American Arbitration Association (“AAA”) held in a location reasonably convenient to entrant/qualifying participant by a sole arbitrator pursuant to the applicable rules and procedures established by AAA. This arbitration agreement is made pursuant to a transaction involving interstate commerce and shall be governed exclusively by the Federal Arbitration Act, 9 U.S.C. §§1-16; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, but in no event will attorneys’ fees be awarded; and (3) no punitive, incidental, special, consequential, or other damages, including, without limitation, lost profits may be awarded (collectively, “Special Damages”); and (4) entrant and/or qualifying participant hereby waives all rights to claim Special Damages and all rights to have such damages multiplied or increased.
Rewards not claimed or that are forfeited will not be awarded. All incurred taxes (federal, state, or local) on or connected with any reward, and the reporting consequences thereof, are the sole responsibility of each qualifying participant.
None of the prize manufacturers or retailers are sponsors of any Company Promotion including, but not limited to: Adidas®, Blue Tees Golf®, Bushnell® Golf, Cleveland® Golf, Coravin®, Corkcicle®, Crate and Barrel®, Dave Pelz Golf®, Duckhorn®, Far Niente, Fortessa®, Hagafen® Cellars, ICON Electric Vehicles, Iron Horse, Ligne W, Migration®, Peter Millar®, Players Towel, Rabbit®, Savage Cellars, Scotty Cameron®, Silver Oak, TaylorMade®, Uncommon Goods®, Vacu Vin®, and Wine Enthusiast®.
The Company reserves the right, in its absolute sole discretion, without prior notice and at any time, to terminate the Promotion, in whole or in part, and to modify and/or suspend these Official Contest Rules.
